If you wish to own an original work, please bear in mind that you will only be the physical owner of a work of universal cultural interest, and that as such you must ensure its conservation and integrity.

In addition, the Law on Intellectual Property stipulates that on acquiring a work of art through purchase, this fact does not imply a right to exploit it.

In this way, legislation wishes the author to participate in the future success of his or her creation, by means of modest remuneration received when the work is reproduced or publicly shown.
And the "Droit de suite" stipulated by the law in the event of re-sal

According to the Law on Intellectual Property, the following irrevocable and non-transferrable rights pertain to the author of a work of art:

  1. DTo decide whether the work is to be shown, and in what form.
  2. To decide whether this showing is to be done under his or her name, under a pseudonym or symbol, or anonymously.
  3. To insist that the integrity of the work be respected and prevent any deformation, modification, alteration or attack on it which might harm his or her legitimate interests or damage his or her reputation.
  4. To modify the work respecting the rights acquired by third parties and the obligations of protection of Goods of Cultural Interest.
  5. To withdraw the work from the market due to a change in his or her intellectual or moral convictions, provided the holders of the right to exploitation are compensated for any damage or harm.
    If the author later decides to resume showing the work, the first option on the corresponding rights must be offered to the previous holder of those rights, on reasonably similar terms to the original ones.
  6. To have access to the only, or rare, example of the work, when this is held by another, in the exercise of the right to show it, or any other pertaining right.
